Health Guarantee and Sale Contract for Pomflower Pomeranians

After deposit is received, you will get your own personalized copy of this contract with your personal information, as well as the registrations and information of the parents, via Google Docs.

A $500 deposit  is required to reserve a puppy- payment is accepted through Postal Money Order, Walmart to Walmart, Cashier's Check, or PayPal.  A signed contract will be sent via email and must be sent back within 48 hours of agreeing to purchase said puppy/dog.   Buyer may make payments via PayPal, Postal Money Order,  or via cashiers check until puppy/dog is paid for.  Puppies need to be paid for by the 11th week of puppies birth or puppy will be relisted for sale, unless other arrangements have been made   * Initials __________________.
 

-FOLLOWING PARAGRAPH APPLIES TO FULL RIGHTS CONTRACT ONLY: The buyer has full rights of AKC registration, legacy breeding using their own kennel name on future litters, as well as the freedom to register dog with other Kennel Clubs. All registration fees are to be paid by the buyer. All puppies are structure evaluated and temperament tested during the 8 weeks of age. At this time it is determined which puppies are pet and which are breeding quality. If this puppy is sold as FULL RIGHTS-BREEDING QUALITY, there are no show or placing guarantees, expressed or implied, as to adult size of puppy, show potential, or breeding ability (ie impotence). This puppy exhibits qualities that maintain quality within the breed, and will meet the breed standards as set forth by the parent club. (http://www.americanpomeranianclub.org/standard.htm) A pup showing out of standard characteristics (ie very large size, poor coat, etc) will under NO CIRCUMSTANCES be given full registration and will be sold ONLY on a spay/neuter contract. Should the puppy develop unfavorable traits prior to going to its new home, the deposit may be transferred to another puppy or refunded.

 

-The Sire & Dam of this pup have been vet checked and shown to be in good health, good cardiac condition, and good patellas. Patella check concluded no grading on the OFA scale. Both have extroverted, proper temperaments as set forth by the APC. “The Pomeranian is an extrovert, exhibiting great intelligence and a vivacious spirit, making him a great companion dog as well as a competitive show dog”
 

-The puppy has been wormed prior to sale and has had their vaccinations for parvovirus, distemper, adenovirus, and parainfluenza. I also vaccinate for coronavirus. Records of vaccinations will be sent with the puppy as well as a recent health certificate from a veterinarian. Due to a more serious strain of canine flu in the U.S. I vaccinate for bordatella as well. I do NOT vaccinate for Leptosporosis. Talk to your vet, check your state’s vaccine requirements and research these vaccines to decide whether your pet will need them.

 

-Should a physical defect be discovered before the puppy goes to its new home, the deposit will be refunded in full to the buyer. Depending on what said defect is, if the buyer is still interested then a special contract with a lowered price and new terms may be worked out, with original buyer having first rights to the new price/contract.

 

-Buyer is to arrange a puppy check up by a qualified vet within 72 hours of receiving puppy (not including Sundays or Holidays).  Pup pick up times are arranged in advance leaving adequate time for the buyer to schedule a wellness check accordingly. Pomflower Pomeranians is not responsible for poor planning or an inability to secure a vet visit within this time frame.  During this initial exam, should your veterinarian detect any communicable disease or life threatening genetic defect at this initial exam, you must return this puppy to Pomflower Pomeranians within 7 days of the exam with the veterinary report of the diagnosis. The buyer is responsible for returning the puppy and all papers (registration, pet guarantee, and shot records) to Pomflower Pomeranians.  In case of death of puppy before the initial exam, the buyer must submit a veterinarian necropsy report as to the cause of death must be entirely due to a covered disease or congenital defect. Breeder shall be notified immediately in the event that the puppy has an illness, is nauseated, becomes lethargic, or does not eat well before the initial vet exam. Failure to have the initial done within 72 hours or to notify breeder of illness or poor eating before initial vet exam will void this warranty. Breeder shall not reimburse any veterinary expense or other expenses incurred by the buyer at any time such as- internal or external parasites, hernia, un-descended testicles, vaccinations, under or overbite, injury, spay/neuter, allergies, heat exhaustion, luxating patellas, retained puppy teeth, or hypoglycemia. Hypoglycemia is preventable with good care and feeding and gentle handling/play while young stops wearing of patellas. 

 

-If your puppy is diagnosed with a life threatening congenital defect making him/her unsuitable as a pet before one year from date of birth, it will be replaced with another puppy. If your puppy is found to have any life threatening defect you must notify us immediately and supply us, within two days of diagnosis, with your veterinarian’s written report. We reserve the right to have the diagnosis verified by another veterinarian of our choice and/or require the buyer to have specific tests run on the puppy to verify the diagnosis before exchange. When the puppy is replaced it will be replaced with one of equal value as soon as available, and you may return the original puppy and all papers to the breeder at Pomflower Pomeranians *or* keep your pup since you have bonded. Please note that, if kept, you will be responsible for their continuing medical bills. Buyer is responsible for all transportation of original puppy if they wish to return them, and must come to Pomflower Pomeranians for the replacement puppy. Puppy must not be euthanized without prior written approval from the breeder or the guarantee is void. Buyer understands that the following slight defects are not considered life threatening and therefore are not covered; hernias, un-descended testicles, under or overbites. Luxating patellas and collapsing trachea can be caused by injury; they are not covered after vet's initial exam. Buyer understands that the replacement option is only valid when health problems are life threatening and are solely to a hereditary problem and are not due to accident or injury. In case of death, a necropsy will be required to determine if death is due to a genetic problem in order to have the puppy replaced. Breeder has the right to request a second opinion from a non-associated State Licensed Veterinarian.

-Giardia and Coccidia are not covered under the health guarantee as they are naturally occurring in the dog’s gut, and times of stress (new homes) can cause them to flare up. Puppies are pre-treated before going to their new homes to ensure this does not happen, but every once in awhile it does pop up. The treatment is simple, usually 5 days on Panacur.

 

-This guarantee applies ONLY to the original puppy owner. This contract can NOT be transferred.

If circumstances become so that the buyer cannot keep this dog, buyer promises not to discard the dog at any shelter, humane society, or rescue group, and to make every effort to place the dog in another suitable home.  In the case that the dog must be given up, Pomflower Pomeranians will make every effort to collect the dog and rehome. If you wish to keep in contact with the dog, your contact information will be passed along to the new owners if they feel comfortable. Violation of this return agreement will result in legal action.

If you cannot afford an emergency or extensive health expenditure on the dog, you must forfeit them to Pomflower Pomeranians to ensure they get proper and humane care. The dog will stay in our possession and will not be returned post-care. Forfeiting to a rescue for veterinary care violates the first agreement and will result in legal action.

This written agreement is a binding contract, and is the only agreement between the buyer and seller. Contract is to be interpreted pursuant to the laws of Bibb County, Georgia  and the venue to determine disputes shall be in Bibb County, Georgia at the 601 Mulberry Street, Macon, Georgia 31201.  Any dispute regarding this agreement shall be brought solely to Bibb County, Georgia. All legal issues and/or court action will be filed in Bibb County, Georgia.
